Noida Authority to Cancel Plot Allotment over Irregularities

Noida Authority took the decision to cancel plot allotment in the absence of adhering rules. An official said, plot owners who failed to obtain Occupancy Certificate within the determined time frame, will face the action.

On 2nd January, the authority pressed last warning notices to respective owners. Failing to which will lead to cancellation process, sources said.

“The authority board has given the last opportunity to these plot owners failing which action will be taken as per the law,” said Lokesh M, Chief Executive Officer (CEO), Noida Authority.

According to rules, builders have to complete construction in the given time frame and have to obtain Occupancy Certificate for the same. Failing to which, the authority is rightful to cancel the plot allotment an official said.

“The Noida Authority has decided to refer cases of industrial plots and IT/IT enabled services (ITES) plots, allotted under both industrial and institutional categories, to the State Government for resolution,” said a Noida Authority official.

Going further the official said, “The referral is intended to provide such plot owners a final opportunity to clear overdue payments or address non-compliance in construction,” he said.

The decision is later stage of the order and Government notification released on June 3, 2022 and December 20, 2023. The order said extension of timeline for declaring plots fully functional until December 30, 2024.

Noida Authority recently checked on the update status of industrial and institutional plots listed under the notification.

Under the Industrial sector, 206 plots was supposed to be completed and declare fully functional by December 31, 2024. Although, 80 plots still remains non-functional and 30 others have payments overdue.

Noida Authority reviewed Plot Completion Status

In the IT/ITES sector in the institutional category, review for 107 plots was also made by the Noida Authority. Out of these, 16 obtained functional certificates whereas 91 remained non-functional.

In the Industrial plot section, out of 206 plots, 114 stand functional, while four were cancelled against liabilities and other issues. Whereas eight plots are in a midst of legal battle.

Also, 80 plots aren’t functional and 30 are facing payment overdue.

Financial constraint is the major factor that hampered project completion, allottees of 21 plots said in the meeting with Noida Authority. Followed by a request for instalment-based payment plan. In the non-functional plots, 82 have completed construction and three are vacant because of ongoing litigation.

Under the Noida Authority, under the IT/ITES sector plots, 107 plots are reviewed in the institutional category. Here, 16 plot owners obtained Occupancy certificates while 91 stands non-functional.

Noida Authority cancelled 29 plots against non-construction, however cancellation was revoked for 18 amongst them. The decision was repealed by the State Government considering revision application.

Following it, 11 plots are tagged with unresolved status, as no restoration application was filed for them. Going further, 78 plots have construction of over 50 percent of their Floor Area Ratio (FAR). However, they are yet to be operational.

Noida Authority aims at facilitating flexible payment plans based on the instalment process. It is a measure considered to assist plot owners facing financial difficulties and aims to adhere with rules.
